Ontario charges land transfer tax in brackets, like income tax. Each rate applies only to the part of the price that falls inside that bracket.   • 0.5% on the first $55,000 = $275
  • 1.0% on the next $195,000 (up to $250,000) = $1,950
  • 1.5% on the next $150,000 (up to $400,000) = $2,250
  • 2.0% on the remaining $400,000 = $8,000
  • Total: $12,475, or $8,475 for an eligible first-time buyer

The first-time home buyer refund: up to $4,000

Ontario refunds up to $4,000 of land transfer tax for eligible first-time buyers. That covers the full tax on a home priced up to about $368,000, and takes $4,000 off the bill on anything above that. To qualify, the buyer generally must:

  • Be at least 18 years old
  • Be a Canadian citizen or permanent resident
  • Never have owned a home, or an interest in a home, anywhere in the world
  • Not have a spouse who owned a home while married to them
  • Move into the home as their principal residence within nine months of buying it

Your real estate lawyer usually claims the refund when the transfer is registered, so it comes off what you owe on closing day. If it was not claimed at closing, you can apply to the Ministry of Finance within 18 months of registration. When only one buyer on title qualifies, the refund is prorated to that buyer’s share.

When land transfer tax is paid

Land transfer tax is paid on closing day through your lawyer, together with the rest of your closing funds. Because it is not part of the mortgage, it has to come from your own savings. Lenders also want to see that you have money set aside for closing costs on top of your down payment, so build it into your budget before you start making offers.

Land transfer tax is only one closing cost. Legal fees, title insurance, the home inspection, property tax and utility adjustments, and moving costs all come on top. On an insured mortgage, Ontario also charges 8% provincial sales tax on the mortgage default insurance premium, and that tax must be paid at closing too.
