Short answer: In a bidding war, a skilled negotiator sets the rules of the game before it starts. For sellers, that means choosing the right offer process, controlling information, and using sign-backs to lift the best offer. For buyers, it means a walk-away number agreed in advance, an offer that’s strong on terms as well as price, and knowing when not to chase.
How multiple offers work in Ontario
- Offer night: the seller sets a date and time to review all offers together.
- Offers any time: the seller reviews offers as they arrive.
- Pre-emptive (bully) offers: a buyer submits before offer night, often with a short deadline.
- Sign-back: the seller counters one or more offers instead of accepting.
- Open offers: since December 2023, a seller can direct their brokerage to share the details of competing offers (without identifying buyers).
All registered offers have to be handled fairly, and buyers are told how many offers are competing. The strategy is in how each step is used.
For sellers: what a negotiator does
- Chooses the process for your home. Offer night suits homes with strong expected demand; offers any time can suit a quieter segment. The choice should follow the data.
- Decides how to treat a pre-emptive offer. Sometimes it’s worth taking; sometimes it signals the price is too low. Your agent should show you why.
- Uses sign-backs deliberately. The goal is to improve the best offer without losing it.
- Reads the whole offer. A slightly lower price with a bigger deposit, no conditions and your preferred closing date can be the stronger offer.
- Keeps your walk-away number private. Information discipline is half of negotiation.
For buyers: what a negotiator does
- Prices from comparables, not emotion. You agree a maximum before you write.
- Strengthens terms. Deposit, closing flexibility, inclusions and conditions can matter as much as price.
- Protects you on conditions. If you go without a financing or inspection condition, you understand the risk and prepare for it in advance (pre-approval, pre-offer inspection).
- Knows when to walk. Losing a bidding war above your number is a win for your finances.
