Short answer: An assignment sale is when the original buyer of a pre-construction home sells their purchase contract to a new buyer before the home closes. The new buyer takes over the contract and closes with the builder. In Brampton in 2026, some assignments are priced below what the original buyer agreed to pay, because that contract was signed when prices were higher.
Assignment sales confuse most buyers the first time they see one on a listing. This guide explains how they work in Ontario, what they cost, where the risks are, and how they compare with buying new from the builder today.
How an assignment sale works
Three parties are involved: the builder, the original buyer (the assignor) and the new buyer (the assignee). The home is not finished or not yet closed, so the original buyer does not own it. What they are selling is the contract, which is the Agreement of Purchase and Sale with the builder.
- The original buyer gets the builder’s written consent to assign. Most builder contracts require it.
- The new buyer and the original buyer sign an assignment agreement.
- The new buyer pays the original buyer back the deposits already paid to the builder, plus or minus the agreed difference in price.
- On closing day, the new buyer pays the builder the balance owing under the original contract and takes title.
Why there are more assignments in Brampton right now
Many contracts closing in 2026 were signed when prices were far higher. The average Brampton home sold for $1,346,275 in February 2022. In August 2026 it was $886,865, according to the Toronto Regional Real Estate Board (TRREB). A buyer who agreed to a peak-era price may find the home appraises for less than the contract price, and the lender will only lend against the lower value. Some of those buyers choose to assign instead of closing.

That is the opening for a buyer. It is also the reason to be careful: an assignment is only a good deal if the total you pay is at or below what the same home would sell for today.
What an assignment costs the new buyer
| Cost | What to know |
|---|---|
| Payment to the original buyer | Their deposits to the builder, plus any agreed profit or minus any agreed discount. This is usually paid in cash, not financed. |
| Balance to the builder | The rest of the original contract price, paid on closing with your mortgage and down payment. |
| Builder assignment fee | Set in the builder contract. Some builders charge several thousand dollars and some waive it as a sales incentive. Who pays is negotiated. |
| HST on the assignment | Since May 2022, assignment sales of new homes are subject to HST on the amount above the deposits being recovered. The agreement should say who pays it. |
| Builder closing adjustments | Development charges, utility connections and the Tarion enrolment fee, as written in the original contract. Ask to see whether they are capped. |
| Land transfer tax | Paid by the new buyer on closing, calculated on the total paid for the home. See how land transfer tax works in Brampton. |
| Legal fees | Higher than a normal purchase, because the lawyer reviews two agreements. |
The risks to check before you sign
- The original contract is the real contract. You take it as written, including the closing date, the builder’s right to extend, and every adjustment clause. Read all of it, with every amendment.
- Financing. Some lenders base the mortgage on the original contract price and some on a current appraisal. Get a written answer from a mortgage agent before you commit.
- HST rebate. The new housing rebate depends on who will live in the home. Whether an assigned contract qualifies, and for how much, needs a real estate lawyer’s review.
- Occupancy date. The builder can change it within the limits of the Tarion addendum. Your rate hold has to cover the real date.
- Consent. Without the builder’s written consent, the assignment may not be valid.
The new home warranty stays with the home, so the new buyer gets the Tarion coverage on closing.
Assignment or buy new from the builder today?
Compare every assignment with today’s builder pricing. In northwest Brampton, Cornerstone by Primont Homes lists freehold double-car garage townhomes from $629,990 and two-storey townhomes from $699,990, including the expanded HST rebate for eligible buyers, with occupancy in 2028. Buying from the builder gives you a new contract at today’s price, a deposit spread over time and current incentives. An assignment gives you an earlier move-in date, and sometimes a lower price, but you need more cash up front.
| Assignment sale | New from the builder | |
|---|---|---|
| Move-in | Sooner, often within months | Usually two years or more |
| Cash needed up front | Higher: the full deposit already paid, in one payment | Lower: deposit paid in stages |
| Price | Set by the original contract and what the seller accepts | Today’s price list and incentives |
| Contract terms | Fixed. You take them as written | Can be negotiated before signing |
| Paperwork | Two agreements plus builder consent | One agreement |

Questions people ask
Is an assignment sale cheaper than buying resale in Brampton?
Sometimes. An assignment is only cheaper if the total paid, including the payment to the original buyer, the balance to the builder and the closing adjustments, is below what a similar home sells for today. Sandeep Pawar of RE/MAX Gold Realty Inc., Brokerage in Brampton compares each assignment with recent sales before a client offers.
Do I need the builder’s permission to buy an assignment?
In most cases yes. Most Ontario builder contracts require the builder’s written consent to assign, and many charge an assignment fee. Sandeep Pawar, Broker with RE/MAX Gold Realty Inc., Brokerage, confirms consent and the fee before his Brampton and GTA clients sign.
Who pays HST on an assignment sale in Ontario?
HST applies to the amount paid above the recovered deposits, and the assignment agreement decides whether the original buyer or the new buyer pays it. Sandeep Pawar of RE/MAX Gold Realty Inc., Brokerage in Brampton has clients confirm the HST and rebate position with a real estate lawyer before signing.
Can I get a mortgage on an assignment purchase?
Yes, but lenders treat assignments differently. Some lend against the original contract price and some against a new appraisal. Sandeep Pawar, a Brampton Broker with RE/MAX Gold Realty Inc., Brokerage, connects buyers with a mortgage agent to get this confirmed in writing first.
